For USA Only The Arizona Lead Acid Battery Act became effective September 27, 1990. Arizona Revised Statues S 44-1321 to 1324 address the sale and disposal of lead acid batteries (LABs). These statutes will affect Arizona dealerships as follows: 1. As a LAB retailer you may only dispose of LABs as follows: – Delivery to a secondary Lead Smelter Delivery to a battery manufacturer – Delivery to a collection or recycling facility, authorized by the Federal EPA or the Arizona Dept. of Environmental Quality – Delivery to an agent of a battery wholesaler 2. A LAB seller must post a written notice clearly visible in the public sales area, which contains the following language: “It is unlawful to dispose of a motor vehicle battery or other lead acid battery in a landfill or any unaut~orized site. Recycle all used batteries. This seller is required by law to accept used lead acid b3tteries. When any new lead acid battery is purchased, an additional fee of $5.00 will be charged unless a used battery is returned for refund within thirty (30) days”. 3. The Legislation requires that the $5.00 fee plus sales tax, be collected at the point of sale in the Parts or Service Department. An Automobile/Motorcycle dealer is exempt from collecting the fee when selling a vehicle. The fee and tax must be refunded to the customer if a used battery is returned within thirty (30) days (with receipt). Thereafter, the seller is permitted to keep the fee. ( ( ( 4. ALL LABs sold after July 1, 1991, over the counter, must bear a universally accepted recycling symbol (“chasing arrows”). New OEM equipment batteries included in new motorcycles have this symbol embossed on the battery housing. Older stoยทck batteries which do not bear this symbol, must have labels affixed to them which have the proper symbol. Enclosed is an initial supply of labels. Additional labels can be ordered from your Technical Services Manager by quoting MCS-053. Be sure to clean the battery thoroughly before affixing the label. 5. All advertisements or promotional material regarding the sale of LABs must contain the following notice in bold print: “A fee is imposed on the purchase of each new lead acid battery unless a used battery is returned where applicable.โ€ข Very truly yours, BMWof North America, Inc.
